Software Contract
A software contract is a legal agreement that governs the understanding and/or condition relationship between a Software Developer and the End User. A software contract sets conditions that end users must agree to before utilizing software as per a software license, and must be in place before any party can use, practice, or otherwise implement the protected intellectual property of the software application.
A software contract protects the owner and/or creator of a software application by defining those conditions end users are required to accept in order to have authorized access to their intellectual property. The software contract is a legally recognized entitlement and serves to alerts end users that software is protected by intellectual property laws and treaties.
Business architecture software falls into one of three categories. Packaged software is essentially used "as is" off the shelf to accommodate general business functions. Partially customized software is pre-developed, existing software which has been tailored to suit a client's particular needs. Tailor-made software is totally customized to the specifications of the client's business. A software contract must take into account the different provision needs and situations associated with each software category.
